Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you (“you”) and Healsens B.V., a company incorporated under the laws of the Netherlands (“Healsens”, “we”, “us”), for your use of the Healsens Store website at store.healsens.com and related ordering, account, checkout, and fulfilment services (collectively, the “Store”).
These Terms should be read together with our Privacy Policy and, where relevant, the Healsens app Terms of Use. If you also use the Healsens mobile application, separate terms may apply to app-specific features.
1. Acceptance
By accessing the Store, creating an account, or placing an order, you agree to these Terms. If you do not agree, do not use the Store.
We may update these Terms from time to time. Material changes will be communicated on the Store or by other reasonable means. Continued use after the effective date of updated Terms constitutes acceptance, unless applicable law requires explicit consent.
2. Eligibility and accounts
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to place orders. The Store is not intended for children under 13 (or under 16 in the EU/EEA).
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Provide accurate registration, billing, and delivery information.
3. Products and services
The Store offers health-related products, laboratory testing services, assessments, and related digital or physical goods (“Products”). Product descriptions, availability, pricing, and delivery options may change.
Some Products require coordination with third-party laboratories, collection partners, or healthcare professionals. Fulfilment times, sample collection, and result availability depend on the Product purchased and your location.
Where a Product links to your Healsens account or app profile, you authorize us to associate the purchase with that account for fulfilment and support.
4. Orders, pricing, and payment
Placing an order constitutes an offer to purchase. We may accept or decline orders (for example due to stock, pricing errors, suspected fraud, or regulatory restrictions). A contract is formed when we confirm the order or dispatch the Product, whichever occurs first under applicable law.
Prices are shown in the currency indicated at checkout and include applicable VAT where stated. Payment is processed by our payment providers (such as Stripe). We do not store full payment card numbers on our servers.
You are responsible for any bank, card, or currency conversion fees charged by your payment provider.
5. Delivery, cancellation, and refunds
Estimated delivery or fulfilment timelines are indicative only. Risk of loss for physical goods passes to you upon delivery to the address you provide, unless mandatory consumer law provides otherwise.
Your statutory rights as a consumer in the European Union or European Economic Area are not affected by these Terms. Where applicable, you may have a right of withdrawal for distance contracts; however, certain health-related or personalised services may be exempt once performance has begun with your express consent, as permitted by law.
Refund and cancellation rules for a specific Product may be stated on the product page or order confirmation. Unless otherwise required by law or stated at purchase, digital goods or services that have been fully delivered or activated may not be refundable.

6. Acceptable use
You agree to use the Store lawfully and only for personal, non-commercial purposes unless we agree otherwise in writing. You must not:
- misuse the Store, interfere with its operation, or attempt unauthorized access;
- provide false, misleading, or incomplete information;
- resell Products or services obtained through the Store without authorization;
- upload unlawful, abusive, or infringing content;
- use the Store in a way that harms Healsens, other users, or third parties.
7. Privacy
Our Privacy Policy explains how we process personal data, including health-related information connected to orders and assessments. By using the Store, you acknowledge that policy.
8. No medical advice or diagnosis
Healsens is not a licensed medical care provider. The Store, its Products, assessments, and any information provided are for general wellness, education, and commerce purposes only. They do not constitute medical advice, diagnosis, treatment, or a doctor-patient relationship.
Always consult a qualified healthcare professional before making decisions about your health. Never disregard professional medical advice or delay seeking it because of information obtained through the Store or related services. In an emergency, contact local emergency services immediately.
Laboratory results and store content may contain errors or omissions. We do not guarantee clinical accuracy, completeness, or suitability for a particular medical purpose.
9. Intellectual property
The Store, its design, text, graphics, logos, and software are owned by Healsens or its licensors and protected by intellectual property laws. Except for the limited right to use the Store as intended, no rights are granted to you.
10. Disclaimers
The Store and Products are provided “as is” and “as available” to the fullest extent permitted by law. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, except where such disclaimers are prohibited.
11. Limitation of liability
To the maximum extent permitted by applicable law, Healsens and its directors, employees, affiliates, and suppliers shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill arising from your use of the Store or Products.
Our total aggregate liability arising out of or relating to the Store or these Terms shall not exceed the greater of (a) the amounts you paid to Healsens for the relevant order giving rise to the claim in the twelve (12) months before the event, or (b) EUR 100, except where liability cannot be limited under mandatory consumer or product liability law.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law.
12. Indemnity
You agree to indemnify and hold Healsens harmless from claims, damages, and reasonable costs arising from your breach of these Terms or misuse of the Store, except to the extent caused by our fault.
13. Suspension and termination
We may suspend or terminate access to the Store or refuse orders if you breach these Terms, create risk or legal exposure, or as required by law. Provisions that by nature should survive termination will survive, including disclaimers, limitations of liability, governing law, and dispute resolution.
14. Governing law and disputes
These Terms are governed by the laws of the Netherlands, without regard to conflict-of-law rules. If you are a consumer resident in the EU/EEA, you retain mandatory protections of the laws of your country of residence.
We encourage you to contact us first at contact@healsens.com to resolve concerns. EU consumers may also use the European Commission’s Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr. We are not obliged to participate in alternative dispute resolution procedures unless required by law.
Subject to mandatory consumer law, the competent courts in the Netherlands shall have jurisdiction, without prejudice to your right to bring proceedings in your country of residence where EU consumer rules so require.
